Terms and Conditions

These terms and conditions apply to all contracts between you and us.

Interpretation
"We", "us, "our", means Inveresk PLC.
"You", "your" means the person ordering products under these terms and conditions.
"Working days" means all days other than Saturdays, Sundays, and UK Public Holidays.
"Product" means the product or products you have ordered from us.

Before Placing an Order
Product Availability
Our availability information is updated regularly, but it is possible that in some instances a title may become unavailable between updates.

We will make every reasonable effort to deliver the products you have ordered within the delivery timeframe applicable at the time of order. If this is not possible, we will notify you and at your option agree a different delivery period or provide a substitute product of equivalent value. Alternatively, you may cancel your order in which case, if your payment card has been debited, we will refund you the purchase price.

On some occasions, we are required by the card issuer to perform additional security checks on the payment card, which can delay the order until the card has been authorised.
The delivery times given are approximate and delays can sometimes occur.

All delivery times quoted on this website are estimates only, these times are based on UK working days.
You will become the owner of the products you have ordered when the products have been delivered to you.

Price
Prices shown on this site include TAX, where applicable. Countries inside the EC will be charged UK TAX. Countries outside the EC will not be charged UK TAX. Delivery charges are extra.

Discounting
Discounts shown are against UK RRP.

Multi-Buys
Prices exclude postage and packing. Promotions apply to listed products only, which are subject to change and availability. If you choose to purchase a product from a multi-buy offer, but do not purchase enough products to qualify for the special discount, the product will be charged at the normal price. Please note that on 3 for 2 promotions (and other multi-buy offers), the lowest priced title will always be the 'free' item.

Delivery of goods to you
a. Inveresk PLC will post, or arrange a courier on your behalf, for the goods ordered by you to the person and address you give Inveresk at the time you make your order. For goods delivered outside of the EC, the consignee (i.e. the person to whom the consignment is sent) will be the declarant and importer into the country for which the consignment is destined. The consignee will be responsible for both customs clearance and payment of customs duties and local taxes where required.

If the shipment address incurs an additional charge for being in a remote area, we will contact you before shipment to inform you of the additional costs, and gain your approval of the additional fee.

Customs charges
If you are ordering goods for delivery outside of the EC, please note that your consignment may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by you. It is accepted by you that Inveresk PLC has no control over additional charges in relation to customs clearance. Inveresk PLC recommend that you check with your local customs officials or post office for more information regarding importation taxes/duties that may be applicable to your online order.

The Contract Between Us
After you have confirmed your order we will send an email to you summarising each order you have placed. When you submit your order we will debit your payment card with the total cost of your order.
Contracts formed between Inveresk PLC and users as a result of using this site shall be governed in all respects by English law and all such users hereby submit to the non-exclusive jurisdiction of the English courts. Completion of the contract between you and us will take place on dispatch to you of the products ordered. This will be deemed to be our acceptance of your offer and to have been effectively communicated to you. This is to be interpreted and enforced with the laws of England, in its entirety and will be subject to the jurisdiction of the English courts.
This disclaimer does not affect your statutory rights as a consumer.
Please note that some of our processes are manual and errors can arise. We carry out frequent checks to detect any errors. If they do occur, we will act immediately to minimise inconvenience and disappointment that may be caused. We reserve the right to cancel any order where obvious errors in pricing or product description have occurred.

Restrictions
Before placing an order you must be aged 18 years or over.
We cannot deliver to PO Box addresses.

Payment Details
We accept payment by Visa, Visa Electron, Visa Delta, MasterCard, Maestro and Solo.
All product prices and delivery charges are shown in UK pounds sterling. Your payment card company will perform any currency conversion. The currency calculator provides estimates only.

Once an Order Has Been Placed
Your Cancellation Rights
It is advisable that you cancel any unwanted orders via email info@stcuthbertsmill.com, before they are invoiced and dispatched. Requests for cancellations may not be actioned for 48 hours in extremely busy periods, which may result in the order being dispatched.

You may cancel your order before the delivery or within seven working days after the date of delivery by email at info@stcuthbertsmill.com or by fax +44 1749 678844, quoting your order number. We will refund you the cost of your unwanted products and our delivery charges.

If you cancel your order within seven working days after the date of delivery, you must return the unwanted products to us unused and in their original packaging at your risk and at your cost within thirty days of delivery. Provided you return the unwanted products unused and in the original packaging within thirty days of delivery, we will credit your payment card with the cost of the unwanted product and our delivery charges once the returned items reach our warehouse.

Price Increases
Inveresk PLC reserve the right to change prices listed without notice. All orders for products are subject to availability and Inveresk PLC reserves the right to refuse to supply to any individual or company.

Pricing Errors
Although we make every effort to ensure the prices on the website are correct, mistakes may sometimes be made. If we discover a mistake in the price of the products you have ordered, we will tell you and give you the option of either reconfirming your order at the correct price or cancelling your order. If we are unable to contact you or we receive no reply from you, we will cancel your order. If your order is cancelled and you have already paid for the products you will receive a full refund.

Limitation of Liability
We will not be liable to you:- For any loss of profit, administrative inconvenience, disappointment, or indirect or consequential loss or damage arising out of any problem in relation to the products you ordered which was not within our reasonable contemplation as a probable result of a breach of contract on our part at the time that our contract with you was concluded.
Where performance of any obligations to you is prevented, frustrated or impeded by any circumstance or caused beyond our reasonable control.

Severability
If any part of these terms and conditions is found to be unenforceable as a matter of law, the enforceability of any other part of these terms and conditions will not be affected.

Governing Law
These terms and conditions and any contract between us shall be governed by and interpreted in accordance with English Law and the English Courts shall have jurisdiction over any disputes between us.

Statutory Rights
These terms and conditions are in addition to your statutory rights as a consumer which remain unaffected.

Upon Receipt Of An Order
Seller Liability
The seller does not accept liability for shortages in quantities delivered unless the buyer notifies the seller of any claim of short delivery of the goods within two working days of delivery. In such circumstances the seller's liability shall be restricted to making good the shortfall.

Making Returns
Products may be returned by post within 7 days of delivery in accordance with the following procedure:-
Repackage the products securely and send the products together with the reason for return, the invoice number, your e-mail address or telephone number and instructions as to whether you would like a refund or a replacement. You will find the Returns address on the paperwork that arrives with your order.
All unwanted goods must be in resalable condition, in their original packaging and with any security seals still intact.
Returns by post are made at your risk. We recommend that you use an insured registered mail service as returns not received by us cannot be credited to you.
Refunds will be credited to your payment card. Refunds will not be paid in cash.

Goods 'Lost In Transit'
Please allow 9 days working days for EC deliveries and 13 working days for the rest of the world. If this time elapses and the goods have not arrived, please contact your local customs office if outside the EC to check whether they have the parcel. If you wish replacement goods to be sent, you must contact us within 28 days of your order being dispatched.
